Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer”) and Swiftwater Mulching (“Company,” “we,” “us,” or “our”) governing all services, estimates, communications, and equipment operations.
By requesting a quote, scheduling services, allowing work to begin, or submitting payment, you agree to these Terms in full.
1. Services
These Terms apply to all forestry mulching, land clearing, vegetation removal, site work, consultations, and equipment-based services performed by Swiftwater Mulching.
2. Estimates & Scope
Estimates are based on visible and disclosed site conditions at the time of quoting.
If actual site conditions differ — including concealed debris, terrain conditions, access limitations, density variations, or hazards — the Company reserves the right to adjust pricing or suspend work until revised terms are approved.
Quotes are valid for 30 days unless otherwise stated.
Minimum service charge: $2,500.
3. Deposits & Payment
Projects exceeding $10,000 require a 10% deposit to secure scheduling.
Deposits are refundable only if cancellation occurs 14 or more days before the scheduled start date. Deposits are non-refundable within 14 days of the scheduled start date.
Unless otherwise agreed in writing, payment in full is due immediately upon completion of services.
Failure to pay may result in collections, lien filings, suspension of future services, and recovery of legal or collection costs as permitted by Michigan law.
4. Customer Responsibilities
Customer represents that they are the property owner or have authorization to approve work.
Customer is responsible for identifying, marking, and disclosing all known underground or concealed hazards, including but not limited to utilities, septic systems, irrigation lines, fencing, drain fields, private electrical lines, structures, or other subsurface conditions.
While the Company may contact Miss Dig (811) for public utility marking, the Company is not responsible for:
Private or improperly marked utilities
Undisclosed hazards
Inaccurate markings
Concealed conditions
Damage resulting from unmarked, undisclosed, or concealed hazards is the responsibility of the Customer.
5. Equipment Operations & Property Conditions
Forestry mulching and land clearing involve heavy machinery and inherent ground disturbance.
Customer acknowledges and accepts that equipment operations may result in soil displacement, surface disturbance, rutting, compaction, vegetation removal, and changes to terrain conditions.
Swiftwater Mulching is not liable for ground disturbance or property condition changes inherent to standard operations.
6. No Warranty
All services are provided as-is without warranties, express or implied, unless specifically stated in writing.
7. Scheduling & Delays
The Company may reschedule services due to weather, safety concerns, equipment conditions, or site inaccessibility without penalty.
8. Right to Suspend or Terminate Work
Swiftwater Mulching reserves the right, in its sole discretion, to suspend or terminate services immediately if site conditions are unsafe, materially different from those disclosed, or if circumstances arise that pose a safety, operational, or legal risk.
Such conditions may include, but are not limited to, hazardous terrain, concealed obstacles, interference by third parties, aggressive behavior, unrestrained animals, unstable ground, weather conditions, access restrictions, or undisclosed hazards.
If work is suspended or terminated for these reasons, the Customer remains responsible for payment for work completed up to that point.
9. Limitation of Liability
To the fullest extent permitted by law, Swiftwater Mulching’s total liability for any claim shall not exceed the total amount paid for the services performed.
The Company shall not be liable for indirect, incidental, or consequential damages.
Customer agrees to indemnify and hold the Company harmless from claims arising from undisclosed hazards, property access issues, or concealed conditions.
10. Governing Law
These Terms are governed by the laws of the State of Michigan.
Any dispute arising from services shall be resolved exclusively in the courts of Livingston County, Michigan.
11. Changes to Terms
Swiftwater Mulching reserves the right to update these Terms at any time. Continued engagement of services constitutes acceptance of any updated Terms.
